These terms apply when you use procoachjoe.com or join a coaching program with Premier Health & Lifestyle, a d/b/a of Shanley Performance Group, LLC. By using the site or enrolling, you agree to them.
Coaching services
We offer online wellness, fitness, and nutrition coaching, including the free Energy & Confidence Scorecard, the free Strategy & Structure Session, and the 12-Week Energy & Confidence Intensive. What's included in a program is described when you enroll.
Not medical care
Coaching is not medical, psychological, or nutritional treatment, and it doesn't replace care from your doctor or other licensed professional. Please read our Disclaimer.
Your responsibilities
- You're 18 or older.
- The information you give us is accurate, including anything about your health.
- You'll check with your doctor before starting a new exercise or nutrition program, especially if you have a medical condition, an injury, or are pregnant.
- You'll tell us right away about any change in your health.
Payments
- The current price and payment options for the 12-Week Energy & Confidence Intensive are shown at enrollment.
- Payments are processed by Stripe.
- Unless prohibited by applicable law, enrolling in a payment plan creates a commitment for the full program price. Stopping participation does not automatically cancel future payment obligations.
- Late payments: a payment is late if it is not received by its due date. We may charge a late fee only to the extent permitted by applicable law and the written enrollment agreement. Any late fee will be disclosed in the applicable enrollment agreement or checkout terms before purchase.
- Disputed or declined payments: if a payment is disputed, reversed, or declined, we may pause coaching access until the account is current.
Program dates
Your program begins on the date of your Week 1 kickoff call or the date individualized programming is first delivered to you, whichever comes first, and runs for 12 consecutive weeks. Your start and end dates are listed in your enrollment confirmation email.
Refunds
You can cancel for a full refund within 3 days of enrolling, as long as your program hasn't started. After the program begins, refunds are handled according to the written enrollment agreement and applicable law. Any payment-plan obligation will be governed by the enrollment agreement and applicable law.
How to cancel
To cancel, email [email protected] with "Cancel" in the subject line. Your cancellation takes effect the day we receive it. Refund eligibility follows the Refunds section above, and payment plan obligations follow the Payments section.
Scheduling
Please give at least 24 hours' notice to reschedule a coaching call. Missed calls without notice may not be rescheduled.
Informed consent
Before starting, you must review and sign our Informed Consent & Assumption of Risk agreement. These terms don't replace that agreement.
Third-party tools
Coaching uses third-party tools such as our coaching app, video call, messaging, and payment platforms. We don't control those services and can't guarantee uninterrupted access to them.
Coaching data
We may use anonymized, de-identified coaching data to improve our programs internally. It won't identify you.
Results
Results vary from person to person and depend on your effort, consistency, health, and many other factors. We don't guarantee any specific result.
Our content
Programs, workouts, emails, videos, and other materials we provide are for your personal use. Please don't copy, share, or resell them.
Limitation of liability
To the fullest extent allowed by law, Shanley Performance Group, LLC is not liable for any indirect or consequential damages from your use of the site or coaching. Our total liability for any claim is limited to the amount you paid us for coaching.
Governing law
These terms are governed by the laws of the State of California. Any dispute will be handled in Amador County, California.
Changes
We may update these terms. The date at the top shows the latest version.
